FHFA Shifts to Objective Risk: What the Proposed Counterparty Rule Means for Mortgage Lenders – 07/21/2026 Weekly Mortgage Update Segment

Hi, I’m Adam DeSanctis with the Mortgage Minute, the latest news from the Mortgage Bankers Association. Last week, FHFA proposed changes to a suspended counterparty program regulation that would remove references to reputational harm and further focus the program on material measurable risks. This regulation has been through several iterations over the past few years. The new proposal builds on earlier revisions that address many of MBA’s concerns and is intended to eliminate unnecessary language while reinforcing the suspension decisions should be based on objective risk, not subjective reputational considerations. This matters because MBA has consistently maintained the suspension is a serious enforcement tool that should be preserved for the most significant misconduct. We’re encouraged that FHFA continues to move the rule in that direction, though there are still areas we’ll review closely. FHFA is accepting comments through August twelfth, and MBA will work with members to evaluate the proposal and determine whether additional comments are warranted. That’s it for this week.
